Kim Zolciak and Kroy Biermann Divorce Trial Date Announced

Kim Zolciak and Kroy Biermann have officially set a date for their divorce trial after a series of tumultuous events. According to legal documents obtained by PEOPLE, the estranged couple will appear in Atlanta’s Fulton County Superior Court on November 5 and 6, 2024. They have until September 25 to reach an agreement through mediation before the trial proceeds.

The news was first reported by TMZ. Zolciak, 46, and Biermann, 38, have had a rocky period since they initially announced their split in May 2023 after nearly 12 years of marriage. Court documents obtained by TMZ at the time revealed that Zolciak described her marriage as “irretrievably broken with no hope of reconciliation.”

The first divorce filing was dropped in July 2023, but Biermann filed again in August. Documents obtained by PEOPLE in September 2023 showed that Zolciak had filed to dismiss her husband’s second divorce filing, citing their recent sexual encounters as proof that their marriage was not “irretrievably broken.” Zolciak stated that she and Biermann had “engaged in marital sexual relations on multiple occasions since the filing of the petition for divorce,” with their most recent encounter being on September 7 of that year.

In November, the couple hinted at a possible reconciliation when Zolciak reverted to using her married name on Instagram. However, a court order on December 11 indicated that the divorce was still moving forward. Fulton County Superior Court Judge Shermela J. Williams ordered the couple to complete mediation to come to a settlement by January 31, 2024.

The court documents stated, “As there are numerous unresolved issues, based upon review of the record and applicable authority, the Court finds that the Parties’ interests and the orderly management of the Court’s docket would be served by referring the above-styled case to mediation. Both Parties must attend the mediation session.”

Among the multiple issues amid the divorce, it was reported in May 2024 that Zolciak had called the police on her estranged husband in April for allegedly stealing her phone and locking himself in her room. The reality star called 911 on April 26 to report that Biermann had allegedly violated a December 2023 court order that required each to stay in separate sides of the house.

The couple, who married in 2011, share six children: twins Kaia Rose and Kane Ren, 10, sons Kash, 11, and Kroy Jagger, 13. Zolciak’s two older daughters, Brielle, 27, and Ariana, 22, were legally adopted by Biermann in 2013.

Legal documents obtained by Us Weekly also confirmed the trial dates and the recommendation for mediation. If the pair do not agree to satisfactory terms, the case will resume in court. Biermann had initially claimed that their union was “irretrievably broken” and requested alimony, child support, and full legal custody of their minor children.

By September 2023, Zolciak claimed via social media that they were still living as “husband and wife,” but Biermann’s lawyer shut down those claims. Biermann’s attorney, Marlys A. Bergstrom, told Us Weekly, “There is no reconciliation, his resolve to see this divorce through to the end has not wavered.”

Amid their divorce, Zolciak and Biermann were ordered in December 2023 to undergo mediation. The pair had the option to either set up a session through Fulton County’s Alternative Dispute Resolution program or use a private service before January, splitting all costs of mediation equally. It is not known how the sessions went.

Zolciak also hinted at her strained dynamics with Biermann in the June trailer for MTV’s The Surreal Life: Villa of Secrets, filmed in the summer of 2023. “Kroy does not want me here,” she claimed in the trailer. “When I go home, I’m getting a divorce.”

Elsewhere in the trailer, Zolciak appeared to get cozy with co-star Chet Hanks, who even called the Bravo star a “MILF.” The pair, however, did not hook up while filming. A source told Us in October 2023, “[Kim] thinks he’s good-looking.”

The divorce between the former Real Housewives of Atlanta stars has been ongoing, with the pair seldom in contact since the separation. The date of separation was listed as April 30, according to court documents obtained by TMZ. Zolciak described her marriage as “irretrievably broken with no hope of reconciliation” and is seeking primary physical custody of their children, joint legal custody, spousal support, and the restoration of her maiden name.

The couple has also faced financial woes, including the foreclosure of their Georgia mansion. According to a notice shared by Fulton County in February, Truist Bank would auction the property after the pair defaulted on a $1.65 million loan taken out in October 2012. However, they recently received an additional 90 days to find a buyer to avoid foreclosure.

The home, which has been on sale for $4.5 million since January, includes seven bedrooms, 11 bathrooms, a heated pool, a private basketball court, and a walk-in wine cellar. There is no word on whether they plan to lower the price further to attract more buyers.
