Valkiria Case: Court Imposes 36-Month Pretrial Detention on Miguel Girao

The Eighth National Pre-Trial Court, led by Judge Raúl Justiniano Romero, has imposed a 36-month preventive prison sentence on José Luis Castillo Alva, Miguel Ángel Girao Isidro, and Giancarlo Valer Enciso. These individuals are connected to the former National Prosecutor, Patricia Benavides.

In addition, the court has mandated strict measures and biometric monitoring every two weeks for Jorge Luis Palomino Quesada, as outlined by the Judiciary through its account on X (formerly Twitter). The legal situation for Jorge Rodríguez Menacho, a former member of the Division of High Complexity Crime Investigations (Diviac), will be addressed in a hearing scheduled for July 30 at 5 PM, during which he is set to be released immediately.

Similarly, the same ruling applies to former advisor Abel Hurtado and Mirtha González Yep, who is in a relationship with José Luis Castillo Alva. Although both were detained, the National Appeals Chamber ordered their release, citing no grounds for a risk of evasion.

Provincial Deputy Prosecutor Julio Ormeño expressed satisfaction with the judge’s decision regarding Girao Isidro, Valer Enciso, and Castillo Alva, although he did file an appeal regarding the ruling on Palomino Quesada.

The court determined that the ties of Miguel Girao were insufficient, leading to concerns that he might flee or destroy evidence. This risk was underscored by the fact that a phone found during a search had been activated early that same day, and Girao had hidden his CPU. The judge also noted that Girao could influence other individuals being investigated.

The court has found substantial and serious evidence against the former advisor. Girao Isidro is implicated in 15 of the 16 incidents being investigated by the Eficcop. These include the removal of Bersabeth Revilla, acts of favoritism toward José María Balcázar, changes to the Special Team Cuellos Blancos, and the appointment of prosecutors in exchange for money. Additional allegations include receiving bribes from Oscar Nieves, purchasing a luxury apartment, filing false complaints against various officials, dismantling the Lava Jato Special Team, and attempting to influence public procurement processes.
